The same structural questions kept appearing at every level: who has authority to act, what data may cross a boundary, and who is accountable when something goes wrong. Agent ecosystems are entering that same phase now. The organizations that define their governance architecture first are not doing compliance work. They are setting the terms.

Today I focus on governance architecture for agentic AI systems. Not model capability, not infrastructure scale. The structural layer above them: what agents may commit to, how data boundaries are enforced across agent chains and organizational lines, and where accountability sits when they act. Governance terms architecture (Layer 2) defines the scope, boundaries, and accountability of agent operation before enforcement is applied. Without Layer 2, Layer 1 is an enforcement engine with no defined mandate: it enforces whatever the organization has defined, and if those terms are undefined or poorly specified, it produces reliable enforcement of the wrong things.

How does the EU AI Act apply to agentic AI systems?

The EU AI Act (Regulation 2024/1689) creates compliance challenges for agentic systems because agents invoke multiple AI components, cross organizational boundaries, and generate commitments autonomously — in ways that resist classification under frameworks designed for discrete models. Key obligations include risk classification (Article 9), automatic logging (Article 12), human oversight with five specific capabilities (Article 14), log retention minimums of six months (Articles 19/26), and conformity assessment (Article 43, deadline August 2026).
